WHAT IS A NOTARY PUBLIC?

A notary public is an individual issued an appointment by the Governor or
Secretary of State to serve the public as an impartial witness, performing notarial
acts as are allowed or required by law.

WHY ARE DOCUMENTS NOTARIZED?

Notarization is intended to deter fraud. The impartial witness (Notary) ensures that the signer of a document is who they say they are, and that the person has indeed signed the document willingly.

HOW DOES A NOTARY IDENTIFY A SIGNER?

Generally, the Notary will ask to see a current identifying document that has a photograph, physical description, and signature. A driver's license, military ID, or passport is usually acceptable.

WHAT EXACTLY IS A NOTARIZATION?

A “notarization” is more precisely called a “notarial act.” This term refers to any act that a notary public is authorized to perform, and includes taking or administering an oath, affirmation, or acknowledgment, taking a verification under oath or affirmation, witnessing or attesting a signature, certifying or attesting a copy, and noting a protest of a negotiable instrument. DOES NOTARIZATION MEAN THAT THE INFORMATION ON A DOCUMENT IS TRUE?

No. Notarization does not prove that information or statements on a document are true or accurate. The signer is responsible for the content of the documents. The notary certifies the identity of the signer.

WHAT IS A NOTARY SIGNING AGENT?

A Notary Signing Agent is a Notary with special expertise in notarizing loan document signings. He or she is hired as an independent contractor by either a real estate lender, a closing agent, or a signing service to ensure that loan documents are delivered to and signed by a borrower, then notarized as necessary and returned for processing in a timely manner.

WHAT ARE THE REQUIREMENTS FOR A NOTARY SIGNING AGENT?

The person must be a commissioned Notary Public. Each state has different requirements for Notary applicants. The Notary Signing agent must have demonstrated knowledge regarding and related to notarization acts, and also be familiar with the loan signing documents to be presented to the borrowers.

WHAT SHOULD I BRING WITH ME TO THE SIGNING?

• A current government issued photo ID , with information that includes a physical description and a signature.
• The document in its entirety that is being notarized. This includes the pages to be signed and the supporting pages.
• All parties must be present for which a signature is required must be present.
